This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the domain name drinkvacay.in ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned and operated by Momento Labs, a company incorporated under the Companies Act, 1956, with its registered office at Flat No: SNO. 5/2, Samata Housing Society, Bapuji Buwa Nagar, Block Sector - Thergaon, Pune, Maharashtra 411033 (hereinafter referred to as "Platform Owner", "we", "us", "our").

Vacay offers ready-to-mix cocktail mixers and related food and beverage products. All product information, including ingredients, shelf life, and usage instructions, is provided on the product pages and labels.

We reserve the right to modify or discontinue any product or service at any time without prior notice.

4. Pricing & Payments

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time. Payments are processed through secure third-party payment gateways (such as Razorpay or PayU). By transacting on the Platform, you enter into a legally binding contract with the Platform Owner.

5. Intellectual Property

All content on the Platform, including but not limited to the brand name "Vacay", logo, design, layout, graphics, text, and product images, is the proprietary property of Momento Labs or its licensors. You are not authorised to reproduce, distribute, or use any content without prior written permission.

6. Disclaimer of Warranties

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. All products and services are provided on an "as is" basis. We expressly disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

In no event will Momento Labs be liable for any indirect, consequential, incidental, special, or punitive damages arising from the use of or inability to use the Platform or its services, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim, or Rs. 100, whichever is less.

The Platform may contain links to third-party websites. These links are provided for convenience and informational purposes only. We have no control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

9. Indemnification

You agree to indemnify and hold harmless Momento Labs, its affiliates, officers, directors, agents, and employees from any claim, demand, or action, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Platform.

10. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms if such performance is prevented or delayed by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, strikes, or government actions.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
